As a parent of a school-age child, I will not send my child to school until the Senate passes the H.R. 1446 THE ENHANCED BACKGROUND CHECKS ACT OF 2021 (H.R. 1446) The 2015 mass shooting at the Emanuel African Methodist Episcopal (A.M.E.) The church in Charleston, S.C. that killed nine innocent people exposed an area of weakness in our federal gun laws, commonly referred to as the “Charleston loophole.” The shooter – who was prohibited by law from possessing a firearm – acquired his gun before the FBI could complete his background check. Although the FBI needed more time to investigate the shooter’s disqualifying records to determine whether the purchase was lawful, federal law allowed the dealer to transfer the gun after three days even though the check was not completed. Under the leadership of Sen. McConnell, the U.S. Senate failed to pass H.R. 1112, legislation that would address the Charleston loophole. In 2021, Rep. Clyburn (D-SC) and Rep. Nadler (D-NY) re-introduced the Enhanced Background Checks Act of 2021 — also known as H.R. 1446 — which would address the Charleston loophole by expanding Brady Background Checks.
